As of 2023, online sports betting is not legal in North Dakota. ND Senate Kills Online Sports Betting Efforts Again

In April 2023, the North Dakota Senate rejected House Concurrent Resolution 3002 by a 16-30 vote. The proposal would have put a statewide mobile sports wagering proposal on the ballot in the next election.

The proposal, introduced by Rep. Greg Stemen, would have required the state legislature to authorize sports betting in North Dakota, with licensing and regulation by the state. The proposal initially passed the House by a vote of 49-44 on Jan. 12. In March 2021, the state’s upper chamber had killed a similar resolution that would have allowed residents to decide if sports betting should come to North Dakota in Nov. 2022.

When Will Online Sports Betting Come to North Dakota?

Had the proposal cleared the Senate, North Dakota voters would have been able to decide in Nov. 2024 whether they wanted to authorize statewide online sports betting as early as 2025. However, since the Senate rejected House Concurrent Resolution 3002 in April 2023, sports wagering remains restricted to the state’s tribal casinos.

Although proponents hope the Senate will reconsider the measure, there will be no regular legislative session in 2024, so North Dakota may not take up the issue before 2025 at the earliest.

How Has North Dakota Sports Betting Reached Here?

The North Dakota Senate in Feb. 2023 rejected a bill that aimed to establish a task force to develop a mobile sports betting implementation plan, regulations, and related legislation. Similar to the 2021 bill, the proposal was unable to gain approval in the Senate, which also rejected similar sports betting bills in 2019.

Tribal-state compacts currently allow for mobile sports betting within the physical boundaries of tribal reservations in North Dakota. However, there is no legal framework for statewide online sports betting.

Support and Opposition to North Dakota Sports Betting Expansion

The proposed sports betting ballot measure in North Dakota faced opposition from some lawmakers who viewed voting for the measure as an endorsement of gambling. Sen. David Rust expressed his opposition to the measure, saying that gambling in the state has expanded to the point where he has no desire to expand it further. Sen. Janne Myrdal stated that sports gambling essentially uses athletes as human commodities for for-profit gambling.

However, supporters of the measure argued that voters should have a say in the matter. Sen. Scott Meyer noted that the proposal is not an expansion or allowance of sports betting but an effort to regulate what is already happening in the state. Meyer stated that doing nothing would not protect those who need help.

Earlier, Rep. Scott Louser cited the frustration of North Dakota residents who are unable to place bets on games within their state. He noted that ND sports gambling fans were forced to visit other states to download the apps and fund their accounts and that the same app wouldn’t work when they returned to their home state. Louser argued that if the majority of North Dakotans think sports betting is bad for the state, they will vote against the measure.
