  • There can be up to 10 retail betting locations in the state. Commercial tracks, casinos, and off-track betting operators can apply for a retail wagering license.
  • The retail license fee is $4,000, and the mobile license fee is $200,000 to offer sports wagering.
  • Maine sports betting is taxed at 10%.
  • Betting on Maine college teams, in-state or out-of-state, is prohibited.

Sports Betting Legalization Efforts in Maine

Maine lawmakers have been trying to regulate sports betting since 2019. The latest sports gambling legalization efforts were renewed in February 2022, with Maine Governor Janet Mills signaling she was ready to bring sports betting to the state.

The Mills administration’s decision to legalize sports wagering came two years after the Democratic governor vetoed a betting bill. With the governor’s nod, Maine’s lawmakers resumed considerations to overhaul the 1980 agreement between the state and the federally-recognized tribes.

State lawmakers approved LD 585 in the early hours of April 19. That came roughly a year after another sports betting bill cleared both the House and Senate before crashing down on the appropriations table.

However, LD 585 eventually made it through, and it marks a compromise from the earlier LD 1352. That original bill would have extended mobile wagering to both tribes and commercial operators. For now, commercial sports betting operators are frozen out.

Why Do Maine Tribes Have Exclusivity Over Mobile Sports Betting?

The Maine sports betting legalization bill – LD 585 – was the culmination of the Mills administration’s efforts to bring about a bittersweet compromise with the leaders of Maine’s Native American tribes.

The tribes, which comprise the Wabanaki Confederacy, do not enjoy the sovereignty their counterparts in most other states do. However, Mills did not want to grant the Wabanaki Confederacy tribal sovereignty, so LD 585 was extended as an olive branch.

Supporters and Opponents of Maine Sports Betting

Gov. Mills supported the bill, terming it the most significant tribal legislation enacted in the state in more than 40 years.

The law provides meaningful economic opportunities for the Wabanaki Nations,” Gov. Mills said. “It incentivizes investment in tribal communities, and it formalizes a collaboration process on policy that sets the foundation for a stronger relationship in the future.”

The Maine Legislature also passed a broader tribal sovereignty bill, LD 1626, lifting a 42-old restriction limiting the rights of tribes to self-govern. But the lawmakers never sent the legislation to the governor, fearing a veto. Mills argued that the tribal sovereignty bill would lead to legal conflicts between the state and the tribes.

The Wabanaki tribes – Penobscot Nation, Passamaquoddy tribes, Houlton Band of Maliseets, and Mi’kmaq – supported LD 585. However, their chiefs said in a statement that the long-term goal would be to get full sovereignty.

Permanent sovereignty restoration remains the legislative priority for the Wabanaki Nations, and it will continue to be our priority moving forward,” the tribal chiefs said following the legislative approval of LD 585.

None of Maine’s tribes currently operates a casino. However, the idea of tribal exclusivity unsettled Maine’s casinos and off-track betting parlors, both of which are reduced to retail wagering only.

Jim Day, the owner of Winners’ Circle OTB in Lewiston, is a long-time proponent of legal betting, said 85% of the market is online. “Taking it away and not allowing the brick-and-mortar locations to compete in that marketplace doesn’t give a level playing field.”

When Will Maine Sports Betting Launch?

The launch of legal Maine sports betting sites may not happen until 2024. Milton Champion, executive director of the Gambling Control Unit, has issued rules on the license application process. This would also cover issues such as advertising, in-person betting facilities, and how to protect players’ data. Champion has stated that the framework may not be ready until the end of 2023.
