“Shall the Nebraska Constitution be amended to state that laws may be enacted to allow for the licensing, authorization, taxation, and regulation of all forms of games of chance to be conducted by authorized gaming operators within licensed racetrack enclosures in Nebraska?“
Nebraskans overwhelmingly approved the gaming initiatives on the November 2020 ballot.
Nebraska lawmakers cleared the sports gambling bill nearly six months after the ballot measure passed. The unicameral legislature approved LB561 in late May 2021. The measure included an emergency clause, ensuring it would take effect immediately after signing.
Without the clause, the bill could have waited three months to take effect in the state.
Many lawmakers, including the bill’s original sponsor, opposed gambling during the debate. But they felt compelled to follow the voters’ wishes expressed in the 2020 ballot measure to permit retail sports betting.
Sen. Tom Briese, himself an opponent of gaming expansion, said the voters gave the legislature a mandate.
“The mandate is they want casinos at racetracks and the property tax relief they will provide. In doing so, they approved all games of chance, including sports betting… I introduced LB561 to clarify what the voters approved and provide some parameters that are both consistent with what the voters mandated and consistent with Nebraska values.”
Although the referendum didn’t explicitly allow or deny sports betting legalization, Nebraska lawmakers chose to include in-person sports betting. However, they opted out of statewide mobile sports betting, online casinos, and online poker games.
Nearly two years after the legislation permitted the industry to launch, Nebraska has yet to see its first retail sportsbook at a pari-mutuel wagering facility. The state’s first racetrack casino (racino) opened in September 2022 in Lincoln without a sports gambling option.
In 2021, the state’s legislature established the framework for gambling in Nebraska casinos, but lawmakers did not finish the rule-making process for sports betting. Finally, in October 2022, the Nebraska Gaming Commission voted unanimously to approve a set of sports betting rules.
However, the rules still needed to be vetted by the Nebraska Attorney General and approved by the governor. If the governor signs off on them, the rules then go to the Secretary of State. Finally, the rules would go into effect after five days.
When asked about a launch date for sports wagering, Nebraska Racing and Gaming Commission Director Tom Sage said the approved rules still need to clear three administrative offices before they can go into effect. In short, there is no confirmed timeline for Nebraska sports betting.
“We really can’t do anything until there are rules and regulations in place,” Sage said.
Currently, there are no plans to allow online sports gambling in Nebraska. The state’s delay in launching retail sportsbooks suggests that the policymakers are not in a rush to take further steps and legalize mobile betting sites anytime soon.
