Legal Online Sports Betting in Nebraska

Nebraska lawmakers legalized sports betting in May 2021, but potential changes to the law have delayed the launch. As of March 2023, in-person sports betting and local Nebraska mobile betting apps are not currently available in the Cornhusker State.

Is Online Sports Betting Legal in Nebraska?

No. Online sports betting was not part of the 2021 piece of legislation that regulated sports gambling in Nebraska.

The only way to bet on sports in Nebraska is via offshore sports betting sites, some of which have existed in the state for the last two or three decades.

Nebraska Sports Betting Law

In late May 2021, the Nebraska governor signed LB561, a gaming bill permitted retail sports betting at pari-mutuel racetracks. Residents must place bets in person at sports betting kiosks at the approved locations, the same ones that already offer pari-mutuel wagering.

These are the major points of the state’s sports betting law:

  • Betting on professional, international, and college sports; individual sports awards; sports drafts but not daily fantasy sports; and esports and simulated games are allowed.
  • Prop betting on individual college athletes or in-state college teams playing in Nebraska is prohibited.
  • Betting on minor league sports or high school sports is also prohibited.

Nebraska Sports Betting Background

Nebraska lawmakers have resisted gaming expansion for decades. However, a 2020 ballot effort garnered enough public support to put the issue up for a vote in the main November election that year. “Keep the Money in Nebraska” was a group that collected nearly 470,000 signatures in a bid to get the gaming initiatives on the ballot.

However, sports betting legalization efforts hit a roadblock in August when the Secretary of State declined to include the initiatives. That elected official reportedly received some opposition to their wording.

The Nebraska Supreme Court heard the case and then ordered that three gaming-related initiatives be put on the November 3 ballot in 2020.

  • The key initiative (No. 429) would amend the Nebraska constitution to allow gaming.
  • Initiative (No. 430) would create the Nebraska Gaming Commission.
  • Initiative (No. 431) would set the tax rate on gaming revenue at 20%.

The key ballot question was:

Shall the Nebraska Constitution be amended to state that laws may be enacted to allow for the licensing, authorization, taxation, and regulation of all forms of games of chance to be conducted by authorized gaming operators within licensed racetrack enclosures in Nebraska?

Nebraskans overwhelmingly approved the gaming initiatives on the November 2020 ballot.

Nebraska Lawmakers Pass Emergency Sports Betting Legislation

Nebraska lawmakers cleared the sports gambling bill nearly six months after the ballot measure passed. The unicameral legislature approved LB561 in late May 2021. The measure included an emergency clause, ensuring it would take effect immediately after signing.

Without the clause, the bill could have waited three months to take effect in the state.

Bill Support and Opposition

Many lawmakers, including the bill’s original sponsor, opposed gambling during the debate. But they felt compelled to follow the voters’ wishes expressed in the 2020 ballot measure to permit retail sports betting.

Sen. Tom Briese, himself an opponent of gaming expansion, said the voters gave the legislature a mandate.

The mandate is they want casinos at racetracks and the property tax relief they will provide. In doing so, they approved all games of chance, including sports betting… I introduced LB561 to clarify what the voters approved and provide some parameters that are both consistent with what the voters mandated and consistent with Nebraska values.”

Although the referendum didn’t explicitly allow or deny sports betting legalization, Nebraska lawmakers chose to include in-person sports betting. However, they opted out of statewide mobile sports betting, online casinos, and online poker games.

Nebraska Fails to Launch Sports Betting, So Far

Nearly two years after the legislation permitted the industry to launch, Nebraska has yet to see its first retail sportsbook at a pari-mutuel wagering facility. The state’s first racetrack casino (racino) opened in September 2022 in Lincoln without a sports gambling option.

In 2021, the state’s legislature established the framework for gambling in Nebraska casinos, but lawmakers did not finish the rule-making process for sports betting. Finally, in October 2022, the Nebraska Gaming Commission voted unanimously to approve a set of sports betting rules.

However, the rules still needed to be vetted by the Nebraska Attorney General and approved by the governor. If the governor signs off on them, the rules then go to the Secretary of State. Finally, the rules would go into effect after five days.

When asked about a launch date for sports wagering, Nebraska Racing and Gaming Commission Director Tom Sage said the approved rules still need to clear three administrative offices before they can go into effect. In short, there is no confirmed timeline for Nebraska sports betting.

We really can’t do anything until there are rules and regulations in place,” Sage said.

When will Online Sports Betting be Legal in Nebraska?

Currently, there are no plans to allow online sports gambling in Nebraska. The state’s delay in launching retail sportsbooks suggests that the policymakers are not in a rush to take further steps and legalize mobile betting sites anytime soon.
