Online sports betting is not yet legal in New Mexico, except for tribal casinos that offer retail wagering at their locations. The state has not yet legalized the industry for online sportsbooks to operate outside of the tribal casinos.

New Mexico, First State to Allow Sports Betting Without Legislation

In New Mexico, tribal casinos began offering sports betting in 2018 without the need for formal legislation. This was due to the classification of the casinos as Class III gaming institutions under the Federal Indian Gaming Regulatory Act, which includes sports betting as a legal activity.

The Santa Ana Star Casino was the first to offer sports betting in October 2018, followed by four more tribal casinos by the end of 2019. These casinos include Buffalo Thunder, Inn of the Mountain Gods Resort Casino, Isleta Resort Casino, and Route 66 Casino.

This sports betting model raised concerns about the legality of the Pueblo of Santa Ana tribe’s opening of a casino sportsbook in 2018. USBookmaking, a Las Vegas-based company, announced an agreement to provide sports wagering services to the Santa Ana Star Casino.

The New Mexico Attorney General’s office stated that they would closely monitor the state’s tribal gaming compacts and work with the New Mexico legislature for proper regulatory oversight to ensure responsible gaming and enhanced integrity. However, they did not interfere with the tribal casinos’ sports betting operations at the time of launch.

How New Mexico Sports Betting Started Without a Sports Betting Law!

Michael Hoenig, general counsel for the National Indian Gaming Commission, explained how New Mexico sports betting started without state legislation. During the second annual US Sports Betting Policy Summit in Nov. 2018, he said that the Pueblo of Santa Ana tribe satisfied two important criteria if the state hadn’t passed sports betting legislation:

  1. The first condition: New Mexico state law cannot explicitly prohibit sports betting. He argued that New Mexico didn’t explicitly ban sports betting and instead negotiated a Class III gaming compact with the tribes.
  2. The second condition: sports wagering must be absent from a list of prohibited Class III games in the tribal compact. According to Hoenig, “Their [Pueblo of Santa Ana] compact, for example, just specifies that the tribe can operate all class-III games; that’s it.”

According to the compact:

“The Tribe may conduct, only on Indian Lands, subject to all of the terms and conditions of this Compact, any or all forms of casino-style gaming, including but not limited to slot machines and other forms of electronic gaming devices; all forms of poker, blackjack, and other casino-style card games, both banked and unbanked; roulette; craps; keno; wheel of fortune; pai gow; and other games played in casino settings; and any form of a lottery.”

When Will New Mexico Legalize Online Sports Betting?

New Mexico lawmakers have not prioritized mobile sports betting, and the last serious attempt to legalize the activity was in 2021 with the introduction of HB 101. The bill would have allowed online and retail wagering at the state’s five racetracks, making New Mexico the first western state with mobile casino gaming. However, the proposal faced political and logistical challenges and failed to pass the House Education Committee.

Any expansion of gaming in New Mexico requires legislative approval and a renegotiated compact with the state’s gaming tribes. The state’s 24 tribal casinos generate significantly more revenue and jobs than the five racetracks. As a result, there is concern that expanded gaming for the racetracks could lower total state revenue, and the gain in taxes from expanded gaming would be unlikely to exceed the nearly $80 million in annual tribal revenue-sharing payments.

Since HB 101 stalled out in the House Education Committee, no significant efforts have been made to legalize NM online wagering. Proposals related to sports betting in the New Mexico legislature have been reduced to commissioning studies to assess gambling in the state, but the most recent proposal died in 2022. Any attempts to legalize mobile sports betting in New Mexico in the future will likely face similar challenges, and the 2023 legislative session has already ended.
